PROJECT TITLE: Improved Capacity of Civil Enforcement Offices
COUNTRIES: Turkey
OVERALL OBJECTIVE: To strengthen the institutional capacity of the Enforcement Offices to ensure effectiveness and efficiency of the enforcement service according to the European standards and best practices.
Specific objectives:
- Capacity building to the Civil Enforcement Offices to enhance the effectiveness;
- Support the capacities and functioning of the Civil Enforcement Offices’ staff and other actors with responsibilities to support/develop their capability and competency;
- Support to analysis and improvement of existing legal framework and bring it into conformity with EU legislation;
- Public confidence on enforcement system enhanced through awareness raising actions.
ACTIVITIES:
Turkey is pursuing National Programs for adopting the acquis communautaire. The enforcement system is an inseparable part of the Judiciary in Turkey, since the enforcement of the judgments rendered by the courts is carried out by the enforcement offices; furthermore, the transactions carried out by the enforcement offices are directly related to the fundamental rights and freedoms. The Ministry of Justice prepared anamendment to the Enforcement and Bankruptcy Law, adopted in 1932, under which the system operates.
The project contributed to the improvement of the amendment law and involved carrying out an in-depth analysis of the changes needed in the structure, organization and functions of the enforcement offices, as well as their legal and institutional framework and drafting strategic plans for their modernization. In addition, it provided training to the enforcement offices in order to enhance the competency of their staff.
